= How do I use materials from PC Study Bible in compliance with copyright laws? =

Often we get asked by customers if they can quote material from PC Study Bible. These are often referred to as "permissions requests", "copyright requests" or sometimes "publication requests". In some cases, people are preparing papers for a specific class assignment, some want to create hand-outs for a group of people, some write articles for publication in magazines, and some are even writing books they plan to publish.

It is important to understand that the content of your specific PC Study Bible program is made up of many different reference works (e.g. "books"). The distribution of these is often restricted by the legal copyright holder, especially when used in a public or commercial setting. Because you bought PC Study Bible, does not mean that you "own the NIV", for example, it means that you have licensed its use under the terms of EULA [link] you agreed to when you installed the software. The content of a PC Study Bible library falls into 3 categories:

Generally speaking, copying and distributing from reference works is not a problem as long as you include the citation from the book's copyright page. You will need to consult the copyrights "within" each reference work for the copyright information. To do so, simply click on the "circle c" symbol along the bottom of the window within the reference work you're using, and copy and paste copyright statement.

You will notice that some publishers (category 1.) are generous in what they allow you to distribute, some are very restrictive. Please consult their copyright statement as instructed above. It is important to realize that you must contact the publisher directly for permission to distribute their content. Biblesoft cannot give permission to distribute what it does not own. For example, if you want to quote the NIV text of the Bible, Zondervan grants permission for up to 500 verses as long as they do not amount to an entire book of the Bible "nor do the verses quoted account for 25 per cent or more of the total text of the work in which they are quoted." If you desire to use the NIV text outside of these parameters, it is your legal obligation to contact Zondervan directly for permission to do so.

With regard to using content from the other 2 categories, as long as the amount you intend to quote is less than 10% of the total text of the work in which it is quoted, you may do so (this is limited to non-commercial and non-competitive uses only). Often you may find a copyright statement appended to your document when you paste the material into your word processor. END-USER LICENSE AGREEMENT

CAREFULLY READ THE FOLLOWING TERMS BEFORE USING THIS PRODUCT. USING THIS PRODUCT INDICATES YOUR ACCEPTANCE OF THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE PRODUCT. RETURN THE PRODUCT PACKAGE WITHIN 30 DAYS OF PURCHASE (WITH YOUR RECEIPT) FOR A FULL AND NO-COST REFUND.

NOTICE TO THE USER: This End-User License Agreement ("Agreement") is a legal contract between you and BIBLESOFT(r) for the use of the Biblesoft product identified above (the "Biblesoft Product"), which may include Biblesoft and/or third-party supplied computer software and associated media, electronic content, electronic data, printed documentation, and on-line or electronic documentation. By installing, copying, or otherwise using the Biblesoft Product, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, you are not authorized to use the Biblesoft Product.

The Biblesoft Product is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Biblesoft Product is licensed, not sold.

LICENSE

You may install the Biblesoft Product onto the computers in your household that are owned by you. You may make backup copies of the Biblesoft Product for your own use. You may not copy, distribute or modify the Biblesoft Product for any other purpose except as set forth in this Agreement.

You may not rent, lease, sublicense or lend the Biblesoft Product. You may, however, transfer all of your rights to use the Biblesoft Product to another party provided that: (1) you transfer this Agreement, the Biblesoft Product, and all copies, updates and prior versions to such party, (2) you retain no copies, including copies stored on a computer, and (3) the receiving party accepts the terms of this Agreement.

If you purchased this Biblesoft Product as an Upgrade to a previous version, you may not sell, rent, lease, sublicense, lend or transfer the previous versions that have been replaced by the Upgrade.

The Biblesoft Authoring System(tm), included with PC Study Bible(r), may be used to create or author content in PC Study Bible format for your personal use, or for non-commercial distribution to others in which no fee is charged, provided the materials you use are in the public domain, or are created or copyrighted by you, or, if the material is copyrighted, you have been legally granted permission to publish the copyrighted materials. Use of the Biblesoft Authoring System to create materials for commercial distribution is subject to the Licensing Agreement that accompanies the Biblesoft Authoring System.

LIMITED WARRANTY; LIMITATIONS ON REMEDIES

Biblesoft warrants that: (1) any disk media and printed user manuals it provides are free from defects in materials and workmanship under normal use and (2) the Biblesoft Product will perform in substantial accordance with its accompanying documentation, for a period of 90 days from the date of receipt. Some states and jurisdictions do not allow limitations on duration of an implied warranty, so the above limitation may not apply to you. To the extent allowed by applicable law, implied warranties on the Biblesoft Product, if any, are limited to 90 days.

NO OTHER WARRANTIES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIBLESOFT AND ITS SUPPLIERS DISCLAIM ALL OTHER WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, WITH REGARD TO THE BIBLESOFT PRODUCT. This limited warranty gives you specific legal rights. You may have others, which vary from state/jurisdiction to state/jurisdiction. Biblesoft's and its suppliers' entire liability and your exclusive remedy will be, at Biblesoft's or its suppliers' option, either: (1) refund of the amount paid, if any, or (2) repair or replacement of the Biblesoft Product that does not meet Biblesoft's Limited Warranty and which you return to the place of purchase with a copy of your receipt. Dealer product return policies may vary. Please see your dealer for details. This Limited Warranty is void if failure of the Biblesoft Product has resulted from accident, abuse or misapplication. Any replacement Biblesoft Product will be warranted for the remainder of the original warranty period or 30 days, whichever is longer. NO OTHER REMEDIES. IN NO EVENT WILL BIBLESOFT OR ITS SUPPLIERS BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING ANY LOST PROFITS, LOST SAVINGS OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE BIBLESOFT PRODUCT, EVEN IF BIBLESOFT OR ANY DEALER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY. In any case, Biblesoft's entire liability under any provision of this Agreement will be limited to the amount actually paid by you for the product. Because some states and jurisdictions do not allow the exclusion or limitation of liability, the above limitation may not apply to you.
